NEW TREC Update for November 2025

At Capital Title, we pride ourselves on our industry insight; recently, TREC made updates to many forms. To stay informed, be sure to keep up with our blog and social media.

On November 3, 2025, the following changes were made:

• Revised Temporary Residential Leases (Buyer’s, Seller’s, Landlord’s) to align with SB 2349 (effective September 1, 2025), removing the flood notice requirement.

• Updated the IABS form (effective January 1, 2026) per SB 1968, adding broker obligations to unrepresented parties and modernizing contact terminology.

The Broker-Lawyer Committee also decided to withdraw pending proposals (e.g., Paragraph 12 updates, water rights disclosures, conservation easements) for further review in January 2026, which TREC approved. Previous proposed contract changes were no longer under consideration.
